Terms of Service

1. General Provisions

1.1. These Terms of Service govern the rights and obligations between the operator of the Pixchemy service, entrepreneur Lukáš Krása, Company ID (IČO): 03804984, registered at Jinočanská 68/16, 161 00 Prague 6, Czech Republic (hereinafter the "Provider") and the user of the Pixchemy web application available at pixchemy.com, related mobile applications, and the progressive web application (PWA) (hereinafter the "Service"). For the best experience, we recommend using a desktop browser.

1.2. By using the Service, you agree to these terms. If you do not agree, do not use the Service.

2. Description of Service

2.1. Pixchemy is a web and mobile application that uses artificial intelligence to restore, colorize, and enhance photographs.

2.2. The Service includes:

• Restoration of damaged photographs
• Colorization of black-and-white photographs
• Resolution enhancement (upscaling)
• AI-powered photo editing and enhancement

3. Registration and Account

3.1. Registration is required to use the Service.

3.2. The user is obligated to provide truthful information, protect their login credentials, and bear responsibility for all activities on their account.

3.3. The user must be at least 13 years old. Persons under 18 require parental or legal guardian consent.

4. Photo Storage

4.1. The Service provides temporary storage for processed photographs. Records may be removed at any time without prior notice.

4.2. Users are advised to download and save their generation results promptly. The Provider is not liable for data loss in the temporary storage.

5. Credits and Payments

5.1. The Service operates on a credit system. Processing photographs consumes credits based on the complexity of the operation.

5.2. The current credit pricing can be found after logging in, in the Pricing section.

5.3. Payments are processed through Stripe. Prices are listed in US dollars (USD), euros (EUR), and Czech crowns (CZK) depending on your settings.

5.4. Purchased credits:

• Do not expire
• Are non-refundable (with exceptions listed in the Refund Policy)
• Cannot be transferred to other users

6. User Content

6.1. The user retains ownership of all uploaded photographs.

6.2. By uploading a photograph, the user grants the Provider a limited license to process the photograph for the purpose of providing the Service.

6.3. The Provider does not use user photographs for AI model training.

7. Limitation of Liability

7.1. The Service is provided "as is." The Provider does not guarantee specific results or uninterrupted availability.

7.2. The Provider is not liable for indirect damages or damages exceeding the amount paid by the user in the preceding 12 months.

7.3. For EU consumers: This limitation does not apply to liability for damages caused intentionally or through gross negligence.

8. Termination

8.1. The user may cancel their account at any time in settings or by contacting support.

8.2. The Provider may terminate an account for violation of these terms.

8.3. After account cancellation, user data is deleted within 30 days.

9. Governing Law

9.1. These terms are governed by the laws of the Czech Republic.

9.2. For EU consumers: Disputes may be resolved through the ODR platform (https://ec.europa.eu/consumers/odr).

9.3. For users in the USA: Disputes shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its consumer dispute rules. Arbitration shall be conducted in English, on an individual basis (not as a class action). Claims not exceeding $10,000 may be brought in the applicable small claims court. You waive your right to participate in class action lawsuits.

10. Changes to Terms

We will notify you of material changes by email or through a notice in the Service at least 30 days in advance. If you disagree with the changes, you have the right to cancel your account before the changes take effect. Continued use of the Service after the changes take effect constitutes acceptance.
